These Terms of Service govern your use of the Braintastic AI website and services. By using our services you agree to these terms.
1. Services
Braintastic AI provides AI agent configuration, deployment, and management services under Self-Hosted and Managed plans as described on our pricing page. Specific deliverables, timelines, and service levels are defined in individual service agreements.
2. Acceptable Use
- You agree to use our services only for lawful business purposes
- You will not use agents built by Braintastic AI for spam, fraud, or deceptive practices
- You are responsible for the content and communications your agents send on your behalf
3. Payment
Self-Hosted plans are charged as a one-time fee due at project initiation. Managed plans are billed monthly in advance. Annual plans are billed annually. All fees are non-refundable except as provided in our 30-day guarantee for new Managed plan clients.
4. Cancellation
Managed plans may be cancelled with 30 days written notice. Upon cancellation you will retain access until the end of your current billing period. Self-Hosted plans are non-cancellable as the service is delivered at project completion.
5. Intellectual Property
For Self-Hosted plans, upon full payment you own the agent code and configuration delivered to you. For Managed plans, Braintastic AI retains ownership of agent infrastructure while operating it on your behalf.
6. Limitation of Liability
Our liability is limited to the fees paid in the three months preceding any claim. We are not liable for indirect or consequential damages.
